Findings of defense medical experts show injuries not causally related to motor vehicle accident

Abrams Gorelick member Glenn A. Jacobson and associate James E. Kimmel recently won a motion for summary judgment before Judge Lucindo Suarez of the Supreme Court, Bronx County. The Court granted summary judgment to the defendant trucking company and defendant vehicle operator, based on plaintiff’s failure to satisfy the No-Fault “serious injury” threshold.
Plaintiff’s injuries allegedly included cervical and lumbar disc herniations and two knee surgeries. Using the findings of the defense medical experts, Abrams Gorelick showed that plaintiff failed to establish that his injuries were causally related to the motor vehicle accident at issue.
