Insurance Coverage

While on a sales trip, the owner of a jewelry company claimed that a briefcase containing hundreds of thousands of dollars in jewelry had vanished from the back seat of his car and must have been stolen.  AGF&J's investigation revealed that the facts did not support an inference of theft as a matter of law.  We argued that the loss was not a theft, but rather a "mysterious disappearance" under the insurer's policy and excluded from coverage.  AGF&J obtained summary judgment for the insurer and the decision was affirmed by the Appellate Division and the Court of Appeals.
